BOARDING & DAYCARE SERVICES AGREEMENT, RELEASE OF LIABILITY & CONSENTS

This Agreement is entered into between Hometown Paws Dog Daycare & Resort, LLC (“Hometown Paws,” “we,” “us”), a Texas limited liability company located in Celina, Texas, and the dog owner identified and signing below (“Owner,” “you”). It governs all daycare, boarding, and related services we provide for your dog. Please read it fully. Your signature confirms you understand and agree to every section.

1. Your Dog & Your Information

You confirm that the information you provide about yourself and your dog (the “Dog”) is true and complete, that you are the legal owner or authorized agent, that you are at least 18 years old, and that you will keep your contact, emergency-contact, and veterinarian information current with us. We will release your Dog only to you or to a person you have listed as an authorized pickup on your intake form or authorized in writing. Keep your authorized pickup list current.

2. Services

What you can expect from us: while your Dog is in our care, we will supervise play, keep suites clean and comfortable, feed your Dog on your schedule and instructions, give rest when your Dog needs it, and contact you promptly if your Dog seems ill, injured, or out of sorts. We provide every service under this Agreement with reasonable care and in line with our posted standards.

• Daycare (Monday–Friday): supervised group or individual play during operating hours.

• Boarding (7 days/week): overnight lodging in an assigned suite, with care per your selected tier and add-ons.

• Add-on services: such as special treats, extra play, or other services we offer from time to time, at posted rates.

Our current operating hours, service rates, and add-on menu are published in detail on our website, hometownpaws.com (our “posted rates”), and are incorporated into this Agreement by reference. The rates displayed in our booking system when you reserve, and confirmed in your booking confirmation, are the rates for that reservation; otherwise, the rates in effect on the date of service apply.

3. Vaccination, Health & Spay/Neuter Requirements

Your Dog must be current on the following vaccinations, with written proof from a licensed veterinarian on file before the first visit:

• Rabies, Distemper/Parvo (DHPP), Leptospirosis, and Bordetella (kennel cough)

• A current negative fecal (intestinal parasite) test

Vaccinations must be administered at least 48 hours before arrival. You acknowledge that vaccines are not 100% effective and that group settings carry an inherent risk of communicable conditions (including kennel cough and canine influenza) even when every dog is properly vaccinated. Your Dog must be in good health, free of fleas/ticks and contagious conditions, and you agree to disclose any illness, injury, or behavioral issue before each stay. We may refuse or isolate any dog that appears ill, parasite-infested, or contagious.

Spay/Neuter Policy: Hometown Paws does not accept intact (unspayed or unneutered) dogs. Puppies may attend intact only up to 10 months of age. Beginning at 10 months, your Dog must be spayed or neutered to attend daycare or boarding. Dogs in heat are not accepted at any age.

Fleas & Ticks: If fleas or ticks are found on your Dog at check-in or during a stay, you authorize us to isolate your Dog as needed.

4. Assumption of Risk & Release of Liability

Please read this section carefully. It affects your legal rights.

You understand that daycare and boarding involve inherent risks, including but not limited to injury, illness, transmission of disease, stress, escape, altercations between dogs, and, in rare cases, death, even when reasonable care is provided. Dogs in group play may bite, scratch, wrestle, or transmit conditions to one another. You voluntarily assume all such risks.

To the fullest extent permitted by Texas law, you release, waive, and discharge Hometown Paws, its members, managers, employees, and agents from any and all claims, damages, costs, or liability arising out of or related to your Dog’s attendance, INCLUDING CLAIMS ARISING FROM OR CAUSED BY THE ORDINARY NEGLIGENCE OF HOMETOWN PAWS, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS, except for harm caused by gross negligence or willful misconduct.

5. Overnight Unattended-Care & Fire-Safety Disclosure (Texas HSC Ch. 824)

Required by Texas Health & Safety Code Chapter 824. You acknowledge that Hometown Paws is not staffed with an employee physically present during the following daily windows: 11:00 AM to 1:00 PM, 7:00 PM to 9:00 PM, and 10:00 PM to 6:00 AM, and that your Dog may be left unattended during those windows. The facility is equipped with a full, functioning fire protection sprinkler system throughout the building, a professionally monitored fire alarm, and a camera monitoring system covering suites and common areas including overnight. You understand that no facility can eliminate all risk of injury or death from fire or other emergencies during unattended hours, and you consent to your Dog being left unattended during the hours stated above and boarded under these conditions. Your signature on this Agreement is your signed consent to this overnight unattended-care and fire-safety disclosure, as required by Texas Health & Safety Code Chapter 824.

6. Emergency Veterinary Care Authorization

If your Dog appears ill or injured and you cannot be reached, you authorize Hometown Paws to obtain veterinary care. We will make reasonable efforts to contact you and your listed veterinarian first; if unavailable, we may use a veterinarian of our choosing. You agree to pay all veterinary, transport, and related costs. You authorize us to approve treatment up to $500 per incident before further attempting to reach you. This authorization does not obligate us to incur any cost on your behalf.

7. Medication Administration

If your Dog requires medication during a stay, you authorize Hometown Paws to administer it according to your written instructions, at posted rates. You must disclose all medications, dosages, and schedules on the intake form and keep them current. We will use reasonable care in administering medication as directed, and you agree that we are not liable for reactions or complications from medication given per your instructions, or from your Dog’s refusal of medication. Dogs requiring medication doses during the unattended windows described in Section 5 cannot be accepted for boarding. We do administer injectable medications, including insulin, when you provide written dosing instructions from you and your Dog’s veterinarian.

8. Behavior, Right to Refuse & Dismissal

Your Dog’s participation, especially in group play, depends on a temperament and behavioral assessment. We may, at our sole discretion, refuse, isolate, remove from group, or dismiss any dog that poses a risk to people or other dogs, or whose owner violates this Agreement. You agree to disclose any history of aggression, biting, or resource guarding. You remain responsible for any injury or damage caused by your Dog to people, other dogs, or property, and for any resulting legal or animal-control action.

9. Photo & Media Release

You grant Hometown Paws permission to photograph and video your Dog and to use those images and your Dog’s name in our social media, website, marketing, and promotional materials, without compensation. This release covers your Dog only and not images of you or other people. Your signature on this Agreement automatically opts you in to this release. If you would like to opt out, notify us in writing at any time.

10. Personal Property

You may send belongings (bedding, toys, bowls) at your own risk. Hometown Paws is not responsible for lost, damaged, or destroyed personal property, and we may withhold items that pose a safety risk.

11. Shared (Double) Suites

Double suites are offered only to dogs from the same household. You consent to your dogs sharing one suite and acknowledge that even bonded housemates may injure one another; you accept that risk. If we determine, in our sole discretion, that co-housed dogs should be separated for safety or comfort, you authorize us to move one dog to a separate suite, and the additional suite will be charged at its posted rate for the remainder of the stay. We will notify you when a separation occurs.

12. Fees, Deposits, Cancellation & Late Pickup

• Charges accrue per our posted rates for the services and dates booked.

• Deposit: A deposit of 50% of the estimated boarding charges is required to reserve boarding.

• Cancellation: Cancel at least 48 hours before your scheduled drop-off and your full deposit is refunded. Cancel between 24 and 48 hours before drop-off and 50% of the deposit is refunded. Cancellations with less than 24 hours’ notice, and no-shows, forfeit the deposit.

• Holiday & high-demand dates: Deposit amounts and cancellation terms for holidays and other high-demand periods may differ from the standard terms above. Any different terms will be disclosed at the time of booking and will control for that reservation.

• Early pickup: boarding is billed for the reservation as booked; picking your Dog up early does not reduce charges or entitle you to a refund of unused nights.

• Late pickup (daycare and boarding): pickup after our posted closing time is charged per dog as follows: $10 if up to 15 minutes late, $25 if 16 to 30 minutes late, and $50 if more than 30 minutes late. If your Dog has not been picked up by the end of our staffed hours, your Dog will stay overnight and the applicable boarding night rate will be charged in addition to the late pickup fee.

• Payment is due in full at pickup, less any deposit already paid. Unpaid balances may accrue charges and prevent future booking.

13. Unclaimed / Abandoned Dog

If you fail to retrieve your Dog within seven (7) days after the scheduled pickup date, your Dog will be considered abandoned. During that period, we will make repeated, documented attempts to reach you and your listed emergency contact using every contact method you have provided. If those attempts fail, you authorize Hometown Paws to arrange appropriate care, transfer your Dog to a licensed shelter or rescue organization, or make other lawful disposition, and you remain liable for all boarding and related charges through the date of transfer. We may assert a lien for unpaid charges to the extent allowed by Texas law.

14. Indemnification

You agree to indemnify and hold harmless Hometown Paws and its members, managers, employees, and agents from any claim, loss, or expense (including reasonable attorney’s fees) arising from your Dog’s actions or your breach of this Agreement, to the fullest extent permitted by Texas law.

15. Governing Law

This Agreement is governed by the laws of the State of Texas. Venue for any dispute lies in Collin County, Texas.

16. Entire Agreement & Severability

This Agreement, together with any policies we post or provide, is the entire agreement between us regarding these services and supersedes prior understandings. If any provision is held unenforceable, the remainder stays in effect. We may update our policies and rates from time to time; continued use of our services after notice constitutes acceptance.
